With a membership of exceeding 900, we are one of Australia's premier yacht clubs and recognised as a national leader in sail training and associated education programs.

YOUR TRANSMISSIONS

TERMS & CONDITIONS OF SALE
No Contract shall come into existence until the Customer's order has been accepted by MHYC and such acceptance has been received by the customer. The contract shall deemed to be concluded at the time and place where such acceptance is received by the Customer.
The products sold and/or services rendered are subject to the Terms and Conditions to the exclusion of any other terms and conditions stipulated or referred to by Customer. The Customer acknowledges that it is aware of the contents of and agrees to be bound by the Terms and Conditions.
These Terms and Conditions are subject to the laws of Australia including without limitation the Trade Practices Act 1974 (the Act).
ORDERS, PRICE AND PAYMENT
The Currency for any transaction subject to these terms of sale shall be Australian Dollars ($AUD).
Unless credit terms have been expressly agreed by MHYC, payment for the products or services shall be made in full before physical delivery of products or services.
Customer shall pay for all shipping and handling charges, where they apply.
Customer shall bear all country, provincial, government, state and local sales, use, goods and services, value added, excise, privilege and similar levies/taxes.
TITLE AND RISK
Title to and risk in the products shall pass to the Customer upon delivery of the products to Customer.
DELIVERY
MHYC shall deliver the products to the place of delivery designated by Customer and agreed to by MHYC ("Place of Delivery").
Any dates quoted by MHYC for the delivery of the products are approximate only and shall not form part of the Contract. MHYC shall not be liable for any delay in delivery of the products and/or services, howsoever caused.
MHYC may revise and/or discontinue Products at any time without notice.
ACCEPTANCE OF PRODUCTS
Unless the Customer notifies MHYC to the contrary on the day of delivery and such notification is confirmed in writing within two days, the Products shall be deemed to have been accepted by the Customer as being in good condition and in accordance with the Contract. The Customer shall not be entitled to withhold payment of all or any of the price of the Products whilst any claim is being investigated by MHYC.
Products purchased under these Terms and Conditions directly may be returned to MHYC by Customer up to fifteen (15) days from the date of the invoice for a replacement, refund or credit of the purchase price. The refund or credit will not include any shipping and handling charges forming part of the purchase price.
Event Fees and Services Purchased under these Terms and Condtions directly are non-refundable, and non-transferrable within seven (7) days of the Event Taking Place or the Service Being Rendered.
WARRANTY
While not affecting any non-excludable warranty or guarantee implied by law, MHYC does not give any warranty that the Products are fit for any particular purpose.
LIABILITY
MHYC shall not be liable in contract or in tort for any loss or damage suffered and consumers rights are limited to those set out in these Terms and Conditions and under statute. To the extent permitted by law, MHYC's total liability herein in respect of each event or series of connected events shall not exceed the total price paid for the purchase of products and/or services under these Terms and Conditions.
The Customer shall indemnify MHYC and keep MHYC fully and effectively indemnified against any loss of or damage to any property or injury to or death of any persons caused by any negligent act or omission or wilful misconduct of the Customer, its employees, agents or sub-contractors or by any breach of its contractual obligations arising out of these Terms and Conditions.
To the extent permitted by law, any typographical, clerical or other error or omission in sales literature, quotation, price list, acceptance of offer, invoice or other documents or information issued by MHYC shall be subject to correction without any liability on the part of MHYC.
Under the Act, where implied conditions and warranties cannot be excluded, MHYC's liability for breach of such conditions and warranties (other than a condition or warranty implied by section 69 of the Act) shall be limited, at MHYC's option, to :
(a) in the case of products, the replacement of the products or the supply of equivalent products; the repair of such products; the payment of the cost of replacing the products or of acquiring equivalent products; or the payment of the cost of having the products repaired; OR
(b) in the case of services, the supplying of services again; or the payment of the cost of having services supplied again.
FORCE MAJEURE
Neither party shall be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of the party so delaying, and such party shall be entitled to a reasonable extension of time for the performance of such obligations.
EXPORT RESTRICTIONS
The Customer agrees to abide by all applicable export control laws and regulations.
GOVERNING LAW
These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales and shall be subject to the non-exclusive jurisdiction of the courts of New South Wales.
GENERAL
The Customer shall not be assign or otherwise transfer any Contracts or any of its rights and obligations hereunder whether in whole or in part without the prior written consent of MHYC. Any such unauthorized assignment shall be deemed null and void.
If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and Conditions and the remainder of the provisions in question shall not be affected thereby.
CONDITIONS OF ACCESS
MHYC may at any time revise these Conditions of Access by updating this version. By using this website, you agree to be bound by any such revisions and should therefore periodically visit this page to determine the then current version of the Conditions of Access to which you are bound.

Privacy Policy
MIDDLE HARBOUR YACHT CLUB (MHYC) PRIVACY POLICY & AUSTRALIAN PRIVACY PRINCIPLES (APP)
MHYC recognises the importance of protecting the privacy of personal information collected from you.
APP 1 – OPEN & TRANSPARENT MANAGEMENT OF PERSONAL INFORMATION
MHYC manages the privacy of the personal information we hold about our customers, potential customers, contractors and others in accordance with the National Privacy Principles (NPP). MHYC is bound by the NPP contained in the Privacy Act 1998. New privacy laws for organisations including registered clubs, covered by the amended Privacy Act came into effect on 12th March 2015. The new laws are outlined in the Australian Privacy Principles appended to this policy.

MHYC has amended it’s Privacy Policy in line with these new principles.
Definition of Personal Information
MHYC collects personal information from members when they join the club. This personal information includes: name, address, email, telephone, date of birth, occupation, details relating to other club memberships, identification checks, bank account details, vessel details (if applicable), preferred methods of communication and information on their preferred activities within the club.
APP 2 – ANONYMITY & PSEUDONYMITY
MHYC can provide option to members of dealing with them anonymously and/or provide the MHYC with a pseudonym. However this option is open to exceptions including where it is impracticable for the club to deal with an individual who hasn’t identified themselves, such as in a membership renewal, or where the law requires or authorises the club to deal with individuals who have identified themselves. This means existing requirements under the Registered Clubs Act for the club to maintain a register of visitors overrides the pseudonym/anonymity requirements in the Privacy Act.
APP 3 – COLLECTION OF SOLICITED PERSONAL INFORMATION
MHYC collects solicited personal information during the course of our relationship with you. This information may be collected with you deal with us over the telephone, send correspondence, visit the website/s that we operate or through personal contact. There may be occasions when we collect information about you from a third party, for example from a work associate who provides such information to us or from a database provided to us.
APP 4 – DEALING WITH UNSOLICITED PERSONAL INFORMATION
If MHYC receives personal information about a member that it did not specifically request, the club will determine whether it would have been permitted to collect the information with the knowledge and consent of the member. If not, the information will be destroyed or de-identified.
APP 5 – NOTIFICATION OF THE COLLECTION OF PERSONAL INFORMATION
MHYC collects personal information so that we are able to effectively provide you with goods and services that we supply, to provide and market our services and to meet our legal obligations. MHYC will notify members at the time, or as soon as practicable after it collects their personal information, about the access, correction and complaints processes outlines in this APP Privacy Policy.
APP 6 – USE OR DISCLOSURE OF PERSONAL INFORMATION
MHYC use the personal information that we collect to provide our services to you, to fulfil administrative functions associated with these services, for example billing, to enter into contracts with you and, or third parties and for marketing and client relationship purposes. When we collect your personal information, we will give you the option of advising us that you do not want us or any third party to use the information for any disclosed secondary purpose. You may also at a later date notify us of your preference on this issue by contacting Club Administration or General Manager.
APP 7 – DIRECT MARKETING
MHYC will obtain members’ consent to receive marketing/promotional information on the club by providing an ‘’opt out” opportunity with any unsolicited marketing/promotional offer.
APP 8 – CROSS BORDER DISCLOSURE OF PERSONAL INFORMATION
MHYC may not disclose personal information to third parties or overseas recipients or “cloud” based database providers without the approval of the member. We do not envisage that we will transfer your personal information to any persons or corporations outside Australia. If it becomes necessary to do so, we will only do so if the recipient of the information is subject to the laws that are equivalent to the National Privacy Principles.
APP 9 – ADOPTION, USE OR DISCLOSURE OF GOVERNMENT RELATED IDENTIFIERS
A commonwealth identifier is a Commonwealth Government or Commonwealth Government agency designated identification number such as a tax file number of Medicare number. We do not use Commonwealth identifiers to identify personal information we have collected from you.
APP 10 – QUALITY OF PERSONAL INFORMATION
The types of personal information that we collect will depend on the circumstances of collection and the kind of service that you request from MHYC. We usually collect personal information such as your name, address, date of birth, email address, company, telephone number, job title, and in some instances, your financial details. When you use the internet, we collect information which you submit as well as information relating to the pages on websites that we operate which you visit.
APP 11 – SECURITY OF PERSONAL INFORMATION
MHYC will take all reasonable precautions to safeguard your personal information from loss, misuse, unauthorised access, modification or disclosure. We use a variety of physical and electronic security measures including restricting physical access to our officers, firewalls and secure databases. MHYC Website uses 128 bit SSL Encryption Technology.
Generally, email is not a secure way to communicate and you should be aware of this when sending personal information to us by email.
APP 12 – ACCESS TO PERSONAL INFORMATION
MHYC will on request provide you with access to the personal information we hold about you in accordance with the Australian Privacy Principles. We may recover our reasonable costs from you in supplying you with access to this information. If we decline to give you access in certain circumstances we will provide you with reasons for this. To request access, please contact Club Administration.
APP 13 – CORRECTION OF PERSONAL INFORMATION
MHYC will take all reasonable steps to ensure that your personal information is accurate, up to date and complete whenever we collect or use it. You may contact us at any time to update your personal information or to tell us that the information is inaccurate or incomplete.
